ADVICE AND STRATEGY

Subject to the Terms and Conditions noted below, Kenward Development Law may be able to assist you with the following:

 

  • legal advice regarding planning, land use and development regulations, including regional growth strategies, zoning, development permits, variances, subdivision, building permits, community amenity contributions, development cost charges, servicing requirements and ‘voluntary’ dedication
     

  • for example:

    • is a rezoning really required

    • is a development permit condition valid

    • is a proposed off-site services condition valid

    • does grandparenting apply

  • legal advice regarding proposed changes to legislation, regulations and bylaws, and the impact of those changes if implemented
     
  • the negotiation of agreements, including Phased Development Agreements and other development agreements, section 219 covenants and servicing agreements  

  • compliance advice, including consideration of the scope of the regulatory power at issue, the validity of the decision making process, and response options in the event of an order or proceedings
     

  • second opinions on issues and positions taken

As a single practitioner firm there are a limited number of engagements that Kenward Development Law Corporation is willing and able to take on, and Kenward Development Law Corporation specifically declines to act for any individual or corporation in the absence of an express agreement to that effect, entered into by Kenward Development Law Corporation and the client, that sets out the specific scope and terms of the retainer.
